Each product sold on the platform It's Tuscany is assisted by legal guarantees on consumer goods, which covers any lack of conformity which becomes apparent within 24 months from the date of delivery of the goods.
What is: The legal guarantee is a guarantee on the sale of consumer goods provided for by Directive 1999/44/CE, also known as "ensuring compliance", which protects you in the event that the products you buy to conformity with the contract of defects sale.
This happens, for example, in the case of products which are malfunctioning, that cannot be used in the manner stated by the seller or for purposes for which they are generally used in products of the same type, which does not have the characteristics or qualities promised by the seller or that do not meet the purpose for which you have purchased.
Duration: The statutory warranty covers defects of conformity which becomes apparent within 24 months from the date of delivery of the product that you purchased, although by that date the defect was not immediately verifiable. For it to be activated you must tell the seller the presence of defect within 2 months since you've discovered. Unless proved otherwise, it is assumed that the lack of conformity which becomes apparent within the first 6 months from the date of delivery of the goods already existed on that date, unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity. We suggest that you always keep your purchasing slip that you find in the product box as well as the documents confirming shipment and delivery of the product.
Am I entitled to statutory warranty?
Who is responsible for: The legal guarantee is rightfully only to the consumer, i.e. who buys products for non-professional purposes.
Against those making claims under: the legal warranty is borne by the seller and the company MPL has no responsibility in this regard.
Rights granted: If the product you have purchased has a defect covered by the Warranty, you are entitled, without having to incur any expense, to repair or replacement of the defective product from the seller. You are entitled to a price reduction or termination of the contract in the following cases: (a) if the replacement or repair of the product are not possible or are prohibitively expensive; (b) if the seller has failed either to repair or replace the product within a reasonable period of time; or (c) if the replacement or repair of the product has caused significant inconvenience. To determine the amount of the reduction of the price or amount to which you are entitled in such cases, account shall be taken of the use you made of the product. Keep in mind that a minor defect that was not possible or prohibitively expensive recourse to the remedies repair or replacement does not entitle to termination of the contract.
